On October 16, 2012, the U.S. Court of Appeals for the District of Columbia reversed Salim Hamdan’s military commission conviction, for retroactive use of antiterror laws. Hamdan v. U.S., ___ F.3d ___ (D.C. Cir., Oct. 16, 2012).

The opinion says the United States is allowed to detain enemy combatants for the duration of hostilities. When will the United States ever say that hostilities with Al Queda and cohorts are over?
