Criminal defense lawyers should examine statutes with a fine-toothed comb. That is what they did this week — in winning at the trial and federal appellate levels — when Benjamin Joshua successfully argued that the federal statutory provision permitting civil commitment of those in Bureau of Prisons custody did not apply to Mr. Joshua, because Mr. Joshua was actually a military prisoner, who was farmed out to the Bureau of Prisons by contract.
