Recent Maryland appellate opinions
Following are two particularly important recent opinions from Maryland’s Court of Appeals:
– The Court affirmed a trial court’s exclusion of a defense expert on witness identification. Bomas v. Maryland, ___ Md. ___ (Jan. 15, 2010).
– The Court found that probable cause to arrest (which arrest revealed PCP possession) was absent based on the totality of the circumstances, including the odor of ether on the defendant. Bailey v. Maryland, ___ Md. ___ (Jan. 14, 2010).
