Gender-based jury pool challenges can be upheld where statutory provisions or court procedures permit automatic jury duty exemptions to women but not to men. Duren v. Missouri, 439 U. S. 357 (1979). Anything less blatant than that presents all the more an uphill battle for making a discrimination-based jury pool challenge, after yesterday’s eight-justice Supreme Court ruling, penned by Justice Ginsburg, in Berghuis v. Smith, ___ U.S. ___ (March 30, 2010).
