Today, Virginia’s intermediate appellate court ruled 3-0 that an aerial photograph is not excludable as hearsay in a criminal nor civil trial. Bynum v. Virginia, ___ Va. App. ___ (Jan. 18, 2011). However, I contend that an extrajudicial claim of what the picture depicts IS hearsay.
