Reflect on that holiday glass of beer, wine or alcohol As a Fairfax DUI lawyer, I suggest you smile at the face you see starting back at y0u, not only for the holiday cheer, but to keep that smile going rather than having it get interrupted by an arresting police officer, by a visit to the jail, by a prosecution, and by needing to hire the services of me or another suitable Virginia DWI attorney. Alcohol is a curious substance. For those without alcoholism or other drinking problems, in moderation alcohol can be an enjoyable and  fun experience. Unfortunately, the Virginia DUI and public intoxication laws are killjoys, starting with applying the following watered down definition of intoxicated: “‘Any person who has drunk enough alcoholic beverages to so affect his manner, disposition, speech, muscular movement, general appearance or behavior, as to be apparent to observation, shall be deemed to be intoxicated.‘ … This definition if applied in all pertinent cases tends to make the law consistent, uniform, certain, stable, and fair, a much desired goal.” Gardner v. Virginia, 195 Va. 945, 954 (1954) (emphasis added). The foregoing definition is also found in the Virginia patter criminal jury instructions and at Virginia Code § 4.1-100

Responsible drinking by a non-alcoholic can be a central part of your Christmas through New Year’s Eve merrymaking. Seeing police emergency lights, hearing a police siren, seeing a police badge and handcuffs, and being loaded into the back of a law enforcement officer’s (LEO) cruiser is not what makes this season merry. Reflect on that image. Expect LEO’s to be out in greater force during this and all other holidays where the liquor flows. Expect many cops to be of two minds while patrolling, those being to feel the holiday cheer but also to justify their time away from joining their family and friends for holiday merrymaking. This increased number of police patrolling the Fairfax and other Virginia roads makes you a bigger target for them to top, investigate and arrest you if you have made the poor decision of getting behind the wheel after consuming beer, wine or alcohol. Yes, hiring an Uber, taxi or other paid driving service can be a pain. Sometimes they do not show up. Sometimes they drive poorly. Think of an automobile driver’s seat after your drinking as being worse than a cesspool that has its contents force fed to the driver. Hopefully that image will be sufficient enough for people to reflect and to avoid drinking and driving.
